Granted: A request to Northumberland County for copies of records at the state maximum fee of 25 cents a page, not 50 cents.
In providing requested records, the county had presented the requester with an invoice for a duplication fee of 50 cents a page.
Upon appeal of the fees by the requester, the Office of Open Records referred the county to the OOR's post fee schedule permitting a maximum of 25 cents a page for record duplication by local or state agencies.
The county responded, citing the Right to Know Law provision that permits legislative agencies to set its own fees. When asked by the OOR to support its claim that it was a legislative, not a local, agency under the law, the county acknowledged it had interpreted the law incorrectly.
