Dismissed as untimely: An appeal to the Office of Open Records which was not submitted within the 15 day time limit.
The appeal was received by the Office of Open Records on July 20, 2009, based on a June 17 response from the Tioga County Commissioners to a Right to Know request. The appeal was received 22 days after the county's response; an appeal must be filed with 15 days of the date of an agency's response.
In a letter to the requester notifying that her appeal had been dismissed, the OOR noted that another request could be submitted to the county, and invited the requester to visit the OOR's website for information about what types of records are exempt from release under the Right to Know Law.
