The requester told the Office of Open Records that his request for records was made April 9, 2009, and that the agency failed to reply. The OOR noted, however, that the appeal was not submitted until Aug. 11.
“An appeal must be filed within 15 business days of the date of the office’s response,” the OOR noted in its letter dismissing the appeal as untimely.
(In the event of a requester failing to receive a response to a request, an appeal must be filed within 15 business days of the date when a response was due, as the request is then “deemed denied.”)
