Misdirected: An appeal filed in error with the Office of Open Records instead of the Erie County District Attorney's Office.

The requester sought law enforcement records from the Erie Police Department, which denied them under the Right to Know Law exception protecting criminal investigation records. The Right to Know Law provides that appeals on denials of law enforcement records are to be filed with the appeals officer appointed by the county district attorney.

The Office of Open Records provided the requester with the name and address of the appeals officer in the Erie County District Attorney's Office, and copied that officer in on the letter to inform it of the pending appeal.
