The agency had denied the request, stating that it was not in possession of the requested records.
Although the requester filed the request under the federal Freedom of Information Act, which does not apply to state records, the agency processed the request under the state Right to Know Law, advising the requester that the department did not have the records he sought.
The department suggested that the requester contact Dauphin County, and advised him on his right to appeal.
In his appeal, the requester stated that the department had a duty to obtain the records for him.
In response, the department provided the Office of Open Records with an affidavit that it did not have the records requested, which the OOR accepted.
